Privatization & Democracy in East Africa

This book explores the role of democracy and Public Law in privatization processes in Kenya, Uganda and Tanzania. It takes a broad approach to privatization, and argues that privatization processes can only be efficient, fair and legitimate if they are democratic.

It therefore recommends the creation of strongly institutionalized Administrative Law mechanisms to facilitate the meaningful democratization of privatization processes in the three countries. In order to make these arguments, the book uses the privatization of water and security as case studies. The book’s motivation is that while much has been written by economists and political scientists on the subject of privatization in Africa, legal scholars have not said much about its ramifications for constitutionalism and democracy.Buy Now

Dr. Migai Akech is an academic based in Nairobi, Kenya. He is a graduate of the University of Nairobi, Cambridge University and New York University (NYU) School of Law, where he was a Hauser Global Scholar.
He has taught at the University of Nairobi, where he was a Senior Lecturer, and NYU School of Law.  He has actively been engaged in research over the last decade and has published widely in reputable international law journals. He is also one of the editors of Environmental Governance in Kenya: Implementing the Framework Law (Nairobi: EAEP, 2008).

He is a Distinguished Faculty Fellow of the Public Procurement Research Center (PPRC) at the Florida Atlantic University.  He is currently working on a project on Administrative Law and the separation of powers doctrine.
